Summary Explanation/Background:
This Developer’s Agreement is submitted in conjunction with the application for the RPUD rezoning request (RPUD Rezoning Ordinance, Exhibit 1), which is also on the Commission agenda. As part of the RPUD rezoning application, the applicant is requesting a construction of 77 single-family homes and a City park (RPUD Rezoning Document, Exhibit 2). The applicant, Habitat for Humanity of Broward, Inc. is requesting to adopt the Developer’s Agreement in order to implement the site development associated with the RPUD rezoning, which includes the construction, dedication, and maintenance responsibilities related to the roads, park, and infrastructure. This Agreement shall become effective upon final adoption (second reading) of the RPUD rezoning request, which is scheduled for July 25, 2017.
