Summary Explanation/Background:
Section 151.03 “Structures in Waterway” of the City Code requires an Agreement between adjacent property owners and the City in order to have property owner’s docks joined within five feet of extended property lines. The attached “Contiguous Shared Common Docking Agreement” is for “Existing Docks”. The City has been provided with a letter from a Florida Registered Professional Engineer that the docks for all three (3) properties are in sound condition with no structural defects (Attached as Exhibit E). In addition, the language in the Agreement indemnifies the City from all liability. City Legal and Engineering have reviewed and concur with this recommendation.
