Summary Explanation/Background:
In 2011 the City of Pompano Beach, the Pompano Beach Community Redevelopment Agency and Broward County entered into an Agreement to design, construct and program a library facility that would include a second floor to be utilized as a Cultural Arts Center. The Agreement included a number of exhibits, one of which was a Lease for the Public Library space. The original vision for the facility was for the public library to be on the 1st floor and for the Cultural Arts Center to be on the 2nd floor.

The overall facility was completed in 2017. The Cultural Arts Center opened in May 2017 and the Library opened in January 2018. The Public Library takes up most of the first floor of the facility. However, the adult reading room is located on the second floor. As a result of this, the County would like to amend the Agreement so that the language in the Lease reflects that the Public Library takes up room on both floors of the facility, rather than just the ground floor. Additionally, the Amended Agreement also proposes a change to the language pertaining to repairs to the facility. The original Agreement allowed the City to commence repairs to the facility within a reasonable time after notice.
