Summary Explanation/Background:

This Sight Visibility Easement Agreement is necessary to ensure that the visibility of the canal from NE 26th Avenue is preserved for the small triangular right-of-way (abutting 2600 NE 5 Street) that is proposed to be abandoned by the City. Such abandonment is also a City-initiated request and is included on this same City Commission agenda (File ID: 18-640). The Abandonment request was unanimously recommended for approval at the December 16, 2015 Planning & Zoning meeting (see attached minutes). The submittal of this Agreement was a condition of that approval prior to placement on a City Commission agenda. The City Attorney’s comments listed in the attached memo #2018-1326 have been addressed.
