Summary Explanation/Background:
The proposed Development Agreement is a companion item to, and submitted in conjunction with, Ordinance No. 2019-200, a PD-I rezoning application for property located at 1508 N. Ocean Boulevard, which is scheduled for Second Reading on tonight's Agenda.

As part of the PD-I rezoning application, the applicant is proposing a number of "improvements" to North Ocean Park including: a new pavilion, restrooms, exterior showers, pedestrian lighting, bike rack, bench seating, landscaping, picnic tables, fitness/exercise equipment, barbecue grills, drinking fountain, trash receptacles, sidewalk, irrigation, and walking trail. The Development Agreement provides that these "improvements" shall be completed by the Developer at its sole cost of not less than $300,000.

The agreement additionally prohibits short term rentals (less than six months) on the property. The developer will also provide decorative crosswalks on A1A and 16th Street as well as an artistic water feature or public artwork at the front of the Development site.

While testimony presented during First Reading of Ordinance No. 2019-200 on July 9, 2019, indicated the Development Agreement would be presented to the Parks and Recreation Advisory Board on July 17, 2019, please note that the Developer has requested to postpone that presentation until after Second Reading (approval) of Ordinance No. 2019-200.
