Summary Explanation/Background:
The property owner(s), Belmont Porten Properties, LLC and Belmont Porten Investments, LLC have submitted a letter of application requesting the City Commission designate the properties identified by Folio #s 494204000391 & 494204090010, as a Brownfield site pursuant to Section 376.80(2)(a), Florida Statutes. This section of the Statute is different from previous application reviews (Section 376.80 (2)(c)), whereas in this instance the City is proposing the designation outside of a specific redevelopment area and that provision has four different criteria for the Commissions consideration. Staff finds that the Belmont Porten properties meets three of the four statutory criteria for designation of a Brownfield site as set forth in Section 376.80(2)(a), Florida Statutes and should be granted the designation. Proper notice has been provided in accordance with Section 376.80(1) and 166.041(3)(c)2, Florida Statutes for this proposed action.
