Summary Explanation/Background:

This is a companion item to an abandonment request, also on this agenda, for a 15-foot Utility Easement by Joseph Valane, Vice President, on behalf of BRE Pompano Industrial Owner, LLC. The Easement is located on property situated at the end of SW 13 Court, west of S. Andrews Avenue (1899 SW 13th Ct.).  An existing water main is located within the easement; therefore the Utility Department requires an agreement for the applicant to replace and reroute the water main to the outside of the proposed building-footprint area.  Per this requirement by the Utility Department, the applicant has submitted the attached executed proposed Utility Easement Agreement that is to be heard concurrently on the agenda with the abandonment request.  The abandonment request was unanimously recommended for approval at the June 3, 2020 Planning & Zoning Board hearing with the condition that this Easement Agreement be submitted.
