Summary Explanation/Background:
The City of Pompano Beach Zoning Code Section 155.5704(C)(2) [Frontage and Access] requires any property subject to Plat, Rezoning, or Major Site Plan approval to dedicate land when determined necessary to maintain the minimum widths of right-so-way established in Chapter 100 [Streets and Sidewalks]. Prior to 2019, all right-of-way dedications needed to be taken to City Commission for acceptance. These requests were largely a ministerial task that were placed on the consent agenda. In an effort to streamline processes, in 2019, the City Commission adopted Ordinance 2019-110, which created an administrative process to accept right-of-way dedications. Following the passage of this ordinance, the City Attorney's office opined that City Commission action was still needed when City or CRA owned property is reclassified as public right-of-way. This text amendment, therefore, explicitly creates an administrative process so that City/ CRA owned right-of-way may be reclassified in accordance with the same general process as private right-of-way dedications. This amendment also creates a process to accept Broward County s right-of-way conveyances.
