Summary Explanation/Background:

This is a Perpetual Beach Storm Damage Reduction Easement which is necessary before the renourishment of City’s beach shoreline can proceed.  The City Commission approved a Beach Storm Damage Reduction Consent of Use November 12, 2019 via Resolution 2020-50.  That agreement specified a term of 50 years upon completion of the project; the US Army Corps of Engineers who is accomplishing the project with federal funding requested the agreement be a perpetual easement instead of the 50-year term.  That change has been incorporated in this easement.  Staff recommends rescinding Resolution 2020-50 and approving the attached easement so the beach renourishment may proceed.  The renourishment is expected to commence January 2021 and complete prior to start of the next turtle nesting season, March 2021.
