Summary Explanation/Background:
The City Commission approved purchase of the property located at 142 SE 14th Street (BCPA folio 494201000723) for $1,200 from the Marvin R. Burkholder Estate with Resolution 2021-112 at the March 23, 2021 Commission meeting with closing to occur 120 days from the contract effective date (April 28, 2021) making the last day to close August 26, 2021.

The property is a 900 square foot vacant lot directly north of the Cypress Nook property the City purchased June 2021 and is needed due to the McNab Road bridge replacement G.O. Bond Project.

As part of the purchase the City had to file an ancillary probate case with Broward County prior to closing on the property since the estate was probated in Allegheny County, PA. The probate hearing has been scheduled for September 1, 2021, after the last day to close on the purchase. Accordingly the City attorney's office prepared an addendum to extend the time for closing to December 16, 2021 to allow time to complete the probate action. The addendum was signed by the required City officials in August due to the Commission Hiatus.

Staff is requesting ratification of the first addendum to the sale and purchase contract to extend the time for closing.
