Summary Explanation/Background:
Development Services Staff noticed a high volume of Variance applications for residential swimming pools located within the street side yards and front yard setbacks of corner lots. Staff conducted an analysis of neighboring city's zoning codes of their swimming pool requirements, and discovered that the majority of the surrounding cities allow pools in both the front and street side yard setbacks. The proposed text amendment seeks to amend the standards of swimming pools, spas, and hot tubs in Pompano Beach to permit the construction within the street side yard and front yard setbacks of corner lots. The fence standards regarding pool requirements are being amended, as well, to reflect this change (notably the existing zoning requirements related to fencing on a corner lot can be implemented & in conformance with the Building Code requirements). This item was presented to the Planning and Zoning Board on August 25, 2021. The P&Z Board provided a unanimous recommendation of approval of this text amendment. Additionally, the CRA provided a Memorandum of support for this proposed text amendment.
