Summary Explanation/Background:
This is a City-initiated rezoning request on behalf of the owner, Edgar Wiggins and A Brilliant Mind, LLC. The request is to rezone the subject property from B-3 (General Business) to B-2 (Community Business). The property is located on the south side of NW 6th Court, approximately 250 feet east of NW 31st Avenue. The vacant subject property includes a total of .14 of an acre. It has a land use designation of Commercial. The Applicant submitted a Flex unit request and intends to construct a single family unit on the property if approved. By rezoning this small lot to B-2, it will enable the property to be eligible for flex allocation. A single-family home could then be built on this property that is surrounded by residential units. This rezoning request was unanimously approved by the Planning and Zoning Board on October 27, 2021.

This rezoning ordinance is being considered with the second reading "first." This is the preferred sequence since this City-initiated rezoning requires a 30 day public notice, which is much lengthier than a typical rezoning application. Completing the second reading "first" will allow time to complete the lengthy public notification and still finalize the rezoning process before the end of 2021. This property owner is already in the building permit process for a single family home; therefore this courtesy will mean a great deal to the property owner.
