The Applicant, Matthew Scott, of Dunay, Miskel and Backman, LLP on behalf of 1307 South Wabash, LLC, is requesting Flex Allocation approval for a maximum of 285 units in order to develop a 285-unit multi-family project. The developer is proposing to pay the in-lieu-of fee for every flex unit allocated that will be built for market-rate housing. The property is located on the west side of Federal Highway between NE 31st Court and NE 33rd Street (AKA: 3151 - 3251 N. Federal Highway) and is currently vacant. The property is zoned B-3 and has a Commercial Land Use designation. The applicant has submitted a conceptual site plan (Exhibit B of the Resolution). Also, a condition of approval is suggested to require the Applicant to meet the affordable housing requirement prior to Building Permit approval by providing an in-lieu-of fee pursuant to Section 154.61(E). In accordance with Section 154.80 Section 154.61(D) the City Code provides the following Review Standards for Flex Allocation - An application shall only be approved on a finding that there is competent substantial evidence in the record that all of the following standards are met: (1) consistency with applicable goals, objectives and policies of the City's Comprehensive Plan and this chapter; and (2) the use of the reserve and flexibility units will produce a reasonable development pattern. The criteria for reasonableness shall include compatibility of adjacent land uses and suitability of the parcel for various development patterns. Staff confirms that the criteria have been met.
