Summary Explanation/Background:

Executing this Declaration is required for unification of lots under different ownership for the purpose of development. The City Commission has previously entered into an agreement (Resolution NO. 2020-11) with DUC Pompano LLC, property owner of 61 NE 1st Street, in order to construct an outdoor bar on an adjacent vacant City owned property (113 NE 1st Ave). The construction of accessory uses is prohibited on a vacant lot unless associated with a principal use (155.4301) either on the same lot or through a unifying agreement. The agreement between the City and adjacent property owner unifying the properties (for development purposes) must be successfully executed in order to obtain a building permit.
